BrakePoint – Terms and Conditions

1. About Us

BrakePoint ("we", "us", "our") is a motorsport performance data and team management platform providing live timing integration, performance analytics, team management tools and related services.

BrakePoint is operated in the United Kingdom.

By accessing or using BrakePoint via our website, web application or mobile application (the "Platform"), you agree to be bound by these Terms and Conditions.

If you do not agree, you must not use the Platform.

2. Eligibility

You must be:

  • At least 16 years old to create an account.

  • Authorised to act on behalf of a team or organisation if registering as a team admin or workspace owner.

You are responsible for ensuring all information provided is accurate.

3. Accounts & Workspaces

BrakePoint operates on a workspace-based system.

When you create an account:

  • You are responsible for maintaining login security.

  • You are responsible for activity under your account.

  • Workspace Owners are responsible for managing user access and permissions.

We reserve the right to suspend accounts for misuse, abuse, or breach of these terms.

4. Subscription Plans & Payments

BrakePoint offers tiered plans, which may include:

  • Free

  • Base

  • Team Starter

  • Team Pro

  • Enterprise

Paid subscriptions:

  • Are billed monthly or annually.

  • Renew automatically unless cancelled.

  • Are non-refundable except where required by UK law.

We reserve the right to change pricing with 30 days’ notice.

Failure to pay may result in suspension or downgrade of service.

5. Data & Performance Analytics

BrakePoint may process:

  • Lap time data

  • Sector/split data

  • Live timing feeds

  • Telemetry (where enabled)

  • Driver performance analytics

Important:

  • Live timing accuracy depends on third-party providers.

  • We do not guarantee uninterrupted or error-free data.

  • Performance analytics are informational only and not professional coaching advice.

Users are responsible for verifying critical race decisions independently.

6. Third-Party Integrations

BrakePoint may integrate with third-party systems including but not limited to:

  • Alpha Timing

  • Speedhive

  • Daytona / ClubSpeed

  • TeamSport systems

We are not responsible for:

  • Downtime of third-party services

  • API changes

  • Data inaccuracies originating from third parties

Use of such services may also be subject to their own terms.

7. Acceptable Use

You agree not to:

  • Reverse engineer or copy the Platform

  • Attempt to access other workspaces without permission

  • Upload malicious code

  • Use the Platform for unlawful purposes

  • Misrepresent driver data or race results

We reserve the right to suspend or terminate accounts that breach acceptable use.

8. Intellectual Property

All platform content, including:

  • Branding

  • Logos

  • UI design

  • Code

  • Analytics models

Remain the property of BrakePoint.

Users retain ownership of their own uploaded data.

You grant BrakePoint a limited licence to process and display uploaded data for platform functionality.

9. Data Protection & Privacy

We process personal data in accordance with:

  • UK GDPR

  • Data Protection Act 2018

Workspace Owners are responsible for ensuring they have consent to upload driver data.

10. Service Availability

We aim for high availability but do not guarantee uninterrupted access.

We may:

  • Perform maintenance

  • Update features

  • Modify functionality

We are not liable for losses resulting from downtime.

11. Limitation of Liability

To the fullest extent permitted by law:

  • BrakePoint is not liable for indirect or consequential losses.

  • Liability is limited to the amount paid for the service in the previous 12 months.

Nothing excludes liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

12. Termination

You may cancel at any time via your account settings.

We may suspend or terminate accounts where:

  • Terms are breached

  • Payment fails

  • Platform misuse occurs

Data retention policies apply after termination.

13. Changes to Terms

We may update these Terms from time to time.

We will notify users of material changes.

Continued use after updates constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
